Suppose the person A and B having common 2 confirmed ticket. The person B is not traveling and person A is traveling and he is not cancelling the other ticket. Person A is used his berth for sleeping and the other birth for keeping his luggage. Is this is legally allowed?

Not Possible the TTE shall allot the Berth to next in line for Clearance sighting B's Absence...
"Legally" is a phrase that is used very very.......very "Loosely" in Indian Railways ;) but as SRG said......the berth will go the next available person on RAC.
the last Sunday i have traveled in 16001 (Trip# 45780) in my coach a lady is traveling with her kid. In fact she is booked 1+2 tickets (1 Adult and 2 Child) but only one child and herself traveled. While checking TTE doesn't verified the the ticket properly she is given her ID to TTE and he finished his job. But in the sleeping time 2 lower bearth are used for sleeping and the remaining 1 MB used for keeping luggage. One W/L (Not RAC) who is sharing the seat with a confirmed ticked (adjustment) is questioned this and made a scene. Finlay TTE came and and ask her why she is not informed the one unused ticket and the TTE is never questioned the W/L pax infact he is supporting him. finally the MB berth is allotted to that guy. in this who is wrong and who is right??
